The meeting between TINGATINGA ARTS COOPERATIVE SOCIETY and TIGER ASPECT PRODUCTION on 31st March 2010
The Tinga Tinga painters from Tingatinga Arts Co operative Society received Claudia Lloyd, the head of Children Animation at Tiger Aspect Production at Ca 10 am at the premises of Tingatinga Arts Co operative Society. They insisted to set up a meeting later that day at 2 pm in the presence of their lawyers from Mpoki Advocates.
The National Arts Council was also invited to the meeting. The meeting started at Palm Beach Hotel at 2 pm. Two lawyers from Mpoki Advocates were present. To representatives from National Arts Council (BASATA) and their lawyer. Both previous and current leadership of TACS were present. Claudia Lloyd, 15 painters inclusive Secretary Rashidi Munayna and Saleswoman Mecky Mkwawa, Abasi Rafiki and Zachi Chimwanda, two Tinga Tinga painters who are currently working for Tiger Aspect in Nairobi were also present. Claudia Lloyd came with the director of HomeBoyz Studio, Myke Rabar. In fact the lawyers attacked the contract itself saying it was void.
They did not want to change anything or improve the contract but break it completely. The argument was that the signing was not witnessed. There were no negotiations about the things like attributions, designs, etc. The key point was to break the contract.
They asked that Walt Disney, BBC, Penguin, Banda and other companies drop the name Tinga Tinga for the Tales altogether and to refrain from using Tinga Tinga on the various products. It was stressed by the lawyers that Tinga Tinga is part of national identity. Tinga Tinga is a national asset, a symbol for Tanzania as a national flag. The government with the Minister of Culture are involved. The painters had no authority to sell the rights to the name. The meeting took ca 2 hours to complete. Claudia and Myke left Tanzania the same day.
My personal feelings are, if these companies weren’t so greedy, this could have been a fantastic outcome for everyone.
Be Happy, Keeping smiling.
